Article 1 — Business Information

Casa Lumos is referred to in these Terms and Conditions as “we”, “us” or “the seller”.

Article 2 — Applicability

1. These General Terms and Conditions apply to all offers, orders and purchases made through the Casa Lumos online store.

2. Customers are given the opportunity to review these Terms before completing a purchase.

3. Nothing in these Terms limits or excludes mandatory consumer rights under Dutch law or applicable European Union legislation.

4. Separate agreements may apply to wholesale and other business-to-business transactions.

Article 3 — Products and Offers

1. Casa Lumos offers handmade scented candles, soy wax candles, wax melts and decorative home accessories, including Jesmonite products.

2. We make reasonable efforts to provide accurate product descriptions, photographs, dimensions, prices and safety information.

3. As our products are handmade, slight variations in colour, texture, pattern and appearance may occur. These variations do not affect statutory rights if a product fails to conform to the purchase agreement.

4. All offers are subject to availability.

Article 4 — Orders and Agreements

1. Customers place an order by completing the checkout process.

2. An order confirmation will be sent electronically.

3. If we cannot fulfil an order, we will notify the customer and refund any payment received for unavailable products.

4. Customers are responsible for providing accurate billing, delivery and contact information.

5. Customers retain their statutory cancellation and withdrawal rights where applicable.

Article 5 — Prices and Payments

1. Consumer prices include applicable VAT where required by law.

2. Shipping costs and other mandatory charges will be displayed before checkout.

3. Payments are processed through the payment methods offered in our online store.

4. Price changes will not affect orders that have already been accepted.

5. International shipments outside the European Union may be subject to customs duties, import taxes and handling charges, as disclosed where required by law.

6. Wholesale pricing and payment arrangements may be agreed separately.

Article 6 — Shipping and Delivery

1. Orders are processed and shipped according to our Shipping Policy, available on our website.

2. Estimated delivery periods will be communicated before purchase. Unless otherwise agreed, consumer orders will be delivered within the statutory period of 30 days.

3. If delivery is delayed, customers retain their applicable statutory remedies.

4. For consumer purchases, the risk of loss or damage generally remains with Casa Lumos until the goods are received by the customer or a person designated by the customer, subject to applicable legal exceptions.

5. If a shipment arrives damaged, incomplete or incorrect, customers should contact info@casalumos.com.

Article 7 — Right of Withdrawal

1. Consumers purchasing products online generally have the right to withdraw from their purchase within 14 days without providing a reason.

2. The withdrawal period normally starts on the day after the customer, or a person designated by the customer, receives the goods. For multiple deliveries under one order, it generally starts after receipt of the final item.

3. Customers may exercise their right of withdrawal by sending a clear statement to info@casalumos.com or using an available online withdrawal function.

4. Products must be returned within 14 days after notifying Casa Lumos of the withdrawal.

5. Customers bear the direct return shipping costs, provided this was clearly communicated before purchase.

6. Customers may inspect products as reasonably necessary to establish their nature, characteristics and functioning. They may be responsible for diminished value caused by handling beyond what is necessary.

7. Legal exceptions apply only where the relevant statutory requirements are met.

8. Handmade products are not automatically excluded from the right of withdrawal.

Article 8 — Refunds

1. Following a valid withdrawal from the entire purchase, Casa Lumos will refund the product price and the original standard delivery costs.

2. Additional costs for premium delivery options are not refundable beyond the standard delivery charge.

3. Refunds will be processed within 14 days after receiving the withdrawal notification.

4. We may withhold reimbursement until the returned goods are received or the customer provides proof of return shipment, whichever occurs first.

5. Refunds will be issued using the original payment method unless otherwise agreed, without additional refund fees.

6. If only part of an order is returned, the original delivery costs generally do not have to be refunded.

Article 9 — Exceptions to Withdrawal

The statutory right of withdrawal may not apply to certain goods, including products made to the customer's individual specifications or clearly personalised, where the legal requirements for an exception are met.

Any applicable exception will be communicated before purchase where required by law.

Standard handmade candles, wax melts and decorative products are not automatically excluded merely because they are handmade.

Article 10 — Legal Guarantee

1. Casa Lumos supplies products that must conform to the purchase agreement.

2. Consumers are entitled to the statutory legal guarantee under applicable Dutch consumer law.

3. If a product is defective or does not meet reasonable expectations, customers may be entitled to repair, replacement, a price reduction or a refund, depending on the circumstances.

4. Any commercial guarantee offered by Casa Lumos is additional to statutory consumer rights.

Article 11 — Product Safety

1. Customers should read and follow the safety instructions supplied with candles, wax melts and decorative products.

2. Never leave a burning candle unattended.

3. Keep burning candles away from children, pets and flammable materials.

4. Products should be used only for their intended purpose.

5. Nothing in this section limits liability that cannot legally be excluded.

Article 12 — Complaints

1. Customers can submit complaints to info@casalumos.com.

2. Please include the order number and a description of the issue.

3. We aim to provide a substantive response within 14 days. If additional time is required, we will inform the customer.

4. Customers retain their statutory rights to pursue available legal remedies.

Article 13 — Wholesale and Business Customers

1. Casa Lumos also supplies products to shops, retailers and other business customers.

2. Wholesale orders may be subject to separate written agreements covering pricing, minimum quantities, payment conditions, production times and delivery arrangements.

3. The statutory consumer right of withdrawal does not apply to purchases made in a business capacity.

4. Mandatory provisions of applicable law remain in force.

Article 14 — Intellectual Property

All original photographs, product designs, branding, descriptions and other original content belonging to Casa Lumos are protected by applicable intellectual property laws.

Commercial reproduction or use without permission is prohibited, except where permitted by law.

Article 15 — Privacy and Personal Data

Casa Lumos processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

Article 16 — Liability

1. Casa Lumos remains responsible for its contractual and statutory obligations.

2. Nothing in these Terms excludes or limits mandatory consumer guarantees, applicable product liability or any other liability that cannot legally be excluded.

3. Any legally permitted limitation of liability will be interpreted in accordance with applicable Dutch law.

Article 17 — Force Majeure

If circumstances beyond our reasonable control prevent or delay fulfilment of an order, we will inform affected customers as soon as reasonably possible.

Any resulting delivery, cancellation or refund rights will be handled in accordance with applicable law.

Article 18 — Governing Law and Disputes

1. These General Terms and Conditions are governed by Dutch law.

2. Consumers residing in other EU countries retain mandatory consumer protections applicable under relevant law.

3. Disputes will be submitted to the competent court in accordance with applicable jurisdiction rules.

4. Customers are encouraged to contact Casa Lumos first to attempt an amicable resolution.

Article 19 — Changes to These Terms

Casa Lumos may update these Terms and Conditions when necessary.

The latest version will be published on our website.

Changes will not retrospectively affect existing purchase agreements unless permitted by law.
